[glossary-ignore]The Removed Child Family Class includes the brothers, sisters, mothers, fathers, grandmothers and grandfathers of a [/glossary-ignore]Removed Child.
Removed Child Family Class Members who are eligible to receive compensation under the Settlement include the Caregiving Parents or Caregiving Grandparents of a Removed Child who were living with and assumed parental responsibilities over the Child at the time of removal.
A Caregiving Parent or Caregiving Grandparent:
- Is the Removed Child’s biological or adoptive parent or grandparent or First Nations Stepparent
- Must have lived with, assumed and exercised parental responsibilities over the Removed Child at the time of removal
- Was the one from whom the Removed Child was first removed
- Must not be a foster parent
- Must not have committed Abuse, as defined under the Settlement Agreement, that led to the removal of the Child
As an adult Caregiving Parent or Caregiving Grandparent, you must submit your Claim by March 10, 2028, regardless of the age of the associated Removed Child.
Every person must submit their own Claim. The exception is if the Claimant is unable to manage their own financial and legal affairs due to mental incapacity or is deceased. In such cases, a representative may submit a Claim on their behalf. Types of representatives include:
[glossary-ignore]Personal Representatives of Removed Child Family Class Members who are Persons Under Disability[/glossary-ignore]
[glossary-ignore]A “Personal Representative” is an individual who is legally appointed to manage or make reasonable judgments or decisions about the affairs of a Person Under Disability.
A Person Under Disability is someone who lacks the mental capacity to manage or make reasonable decisions about their affairs and has a legally appointed Personal Representative.[/glossary-ignore]
[glossary-ignore]Representatives for Deceased Removed Child Family Class Members[/glossary-ignore]
[glossary-ignore]A “Representative” for a Deceased Caregiving Parent or Caregiving Grandparent is:
- An individual who is legally appointed to represent the estate of the Deceased Caregiving Parent or Caregiving Grandparent by way of a Grant of Authority (such as a will); or
- A living heir of the Deceased Caregiving Parent or Caregiving Grandparent. Only certain heirs may be eligible to represent a Deceased Class Member and receive compensation on their behalf.
